By downloading, installing, or using the Fickle mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Fickle is operated by AR Capital Innovations Pty Ltd ("we," "us," or "our"), an Australian company.

Fickle is a voice-first idea capture application that allows you to:

• Capture thoughts and ideas using voice or text
• Organize captures with categories
• Set reminders and notifications
• Sync your data across devices

To use Fickle, you must:

• Create an account using Apple Sign In, Google Sign In, or email verification
• Provide accurate and complete information
• Be at least 13 years of age
• Keep your account credentials secure

You are responsible for all activity that occurs under your account.

You agree not to use Fickle to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated means to access the service without permission

You retain ownership of all content you create in Fickle ("Your Content"). By using the App, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the service to you.

You are solely responsible for Your Content and any consequences of sharing or storing it.

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

We strive to provide reliable service, but we do not guarantee that Fickle will be available at all times. We may:

• Modify or discontinue features with or without notice
• Perform maintenance that may temporarily affect availability
• Suspend or terminate accounts that violate these Terms

Fickle and its original content, features, and functionality are owned by AR Capital Innovations Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.

Fickle is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy or reliability of any information
• Uninterrupted or error-free operation
• Security of your data (though we take reasonable precautions)

To the maximum extent permitted by law, AR Capital Innovations Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of Fickle.

You agree to indemnify and hold harmless AR Capital Innovations Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Fickle or violation of these Terms.

You may terminate your account at any time by deleting it through the App or contacting us. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of Fickle after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of Fickle shall be resolved in the courts of Victoria, Australia.
